GENERAL CONDITIONS OF CARRIAGE

SLM’s General Conditions of Carriage for passengers and baggage (“General Conditions of Carriage”) shall be applicable. These General Conditions of Carriage are available from SLM and its authorized agents free of charge and can be viewed on-line at www.flyslm.com, will also be sent to you upon first request and at the end of the purchase process. To the extent any provision or notice contained or referred to herein is contrary to any of the provisions in the General Conditions of Carriage, the General Conditions of Carriage take precedence.

DENIED BOARDING, CANCELLATION AND DELAYS

SLM takes all necessary measures to avoid delays, cancellations or denied boarding. However, in the event you are denied boarding, your flight is cancelled or delayed for minimum of one hour, SLM will offer compensation and assistance, as required under the applicable regulation.

If you are located in a destination other than your point of origin and your baggage is either lost or delayed, SLM will offer you the amount of USD 50,00, as reimbursement for your expenses.

PROHIBITED ITEMS

The list of prohibited items below is not exhaustive and is updated as needed. To ensure the safety of civil aviation, the Director of Security of SLM may evaluate an item that is authorized to be included in checked baggage as an unauthorized item, if necessary.

Passengers are advised to check with their travel agent or air carrier for additional policies and restrictions on any item to be transported. It is passenger’s responsibility verifying if an item is illegal in the country of destination. Below is a non-exhaustive list of prohibited items:

It is also forbidden to use electrical devices, which could interfere with the aircraft’s radio and navigation equipment, e.g. radios and portable telephones.

Passenger must refuse the transportation of items received from strangers, whether in carry-on or checked baggage.

If passenger refuses to submit to the security inspection, access to the restricted area and boarding will be denied.

ARMED PASSENGERS

SLM does not transport armed passengers, nor does it dispatch firearms and ammunition.

UNRULY PASSENGERS

In the event of an incident involving a disorderly passenger, to ensure the safety of the other passengers, SLM may call the Federal Police or the police agency responsible for the case.

The Tokyo Convention clarifies and justifies the actions of the aircraft commander to suppress the actions of passengers committing offences or actions that may otherwise jeopardize good order and discipline on board. The pilot in command (“PIC”) has powers to take such reasonable measures (including passenger restraint) of arrest and can delegate those powers to members of the crew and to passengers on board the flight necessary to:

• Protect the safety of the aircraft or of the persons or property on board the aircraft;
• Maintain good order and discipline on board the aircraft; and
• Disembark any passenger and/or deliver such passenger to the authorities on the ground.

When passengers demonstrate violent or unruly behavior onboard a Surinam Airways aircraft and almost in every case, sympathetic handling and reassurance by the Cabin Crew is pursued to calm the passenger. However, where an unruly or violent passenger cannot be subdued, passenger restraint devices may need to be used. The PIC has powers to arrest and take such reasonable measures to restrain the passenger. He/she can delegate those powers to members of the crew and to passengers on board the flight.

PASSENGERS UNDER CUSTODY

Inadmissible passengers and deportees and any item they carry, whether or not accompanied by an escorting officer(s), shall be subjected to thorough security screening.

Inadmissible and deportee passengers are persons, who are being removed by a particular country’s authority, that have been the subject of judicial or administrative proceedings and are classified as follows: • DEPU – A deportee who does not require an escort during his/her carriage (deportee unaccompanied). • DEPA – A deportee who requires an escort during his/her carriage (deportee accompanied) • INAD – Inadmissible is a person who has been refused (or will be) entry to the country for a variety of reasons, the most common being the lack of proper documentation (e.g. due to problems with passport, visa etc.).  Usually the carrier that transports the passenger into the country is responsible for their immediate carriage back to either the country of origin or departure.

When circumstances such require inadmissible passengers may be escorted. Deportees under 12 years of age are not included in the number of deportees counted.

For Flight Safety reasons, inadmissible and deportees exceeding a number of 2 per flight, shall not be seated on board as a group, but separated. Immigration officer(s) or designated person(s) will bring INAD(s) and DEPU(s) to the aircraft in order to ensure their departure. The travel documents shall be handed over to the purser of the specific flight. The station of final destination will be informed and upon arrival of the flight the security or designated person shall collect the travel documents from the purser and escort the INAD(s) and or DEPU(s) to the Immigration counter.

DEPA - May be escorted by local policing authorities and or when directive is given by the Director of Security, by airlines security officers. They will be embarking the aircraft before other passengers and deplaned after all other passengers have disembarked.

Alcohol beverages shall not be served to any inadmissible passenger(s) / deportees and to any disruptive / unruly passenger(s).

All deportees being transported as the result of a judicial decision or State authority order, regardless of whether or not they are being accompanied by an escorting officer(s), shall be subjected to a thorough security screening. A physical search of his person and his cabin baggage shall be performed.

The PIC of the aircraft shall be informed of the status of the passenger and provided with an assessment regarding the likelihood of the passenger becoming disruptive during the flight.

In case the PIC considers that the passenger may become disruptive, he may request escort for the passenger. If the PIC is not convinced that the passenger will pose no risk to the flight even under escort, he shall refuse the carriage of the passenger. In both cases of a request for escort, or refusal for transport, the PIC shall make notice of this in his trip report. Based on previous criminal record or information supplied by the government in case of a high-risk criminal the Director of Security may deny boarding of such passenger.

Note:
1A. Applicable to Economy class baggage where the allowance is 2 (two) pieces: A maximum of 3 (three) pieces are allowed as checked baggage, however simultaneous transport of the number of extra pieces depends on availability of space.

1B. Applicable to Economy class baggage where the allowance is 2 (two) pieces: A maximum of 4  (four) pieces are allowed as checked baggage, however simultaneous transport of the number of extra pieces depends on availability of space.

2. Items in excess of 32 kg (70 lbs) will not be accepted as baggage and may only be transported as freight. For freight please contact SLM Cargo.

Excess baggage with discount (Only applicable on the Mid-Atlantic route between Paramaribo and Amsterdam)

Excess baggage between Paramaribo and Amsterdam, can be paid in advance at SLM authorized travel agents or own ticketing offices with a discount of € 25.00/$25.00 on the applicable excess baggage rate and under the following conditions:

• Prepayment is allowed before / on the departure day (5 hours before departure);
• Prepayment is permitted for the entire travel route (outward and / or return journey) on SLM flights.
• Prepayment for the outward and return journey is equal to 2x the applicable rate and with a discount on the onward and return journey.
• Pre-payment for excess baggage only applies to ticketed PNRs (PY-record locator). 

Note:    Payment for excess baggage at the airport is not considered as prepayment. 
Excess baggage is not subject to commission. 

Important

• Partially unused paid total excess baggage amount that has been paid in advance is non-refundable.
• Total paid excess that is paid in advance and completely unused, on the MID-Atlantic route, is refundable after deduction of administration costs of 50 %.
• Total paid excess baggage paid in advance and completely unused, on the regional route is non-refundable. 

In case of payment of excess baggage costs at the airport (during check-in), no discount is granted on the applicable excess baggage rate and also if excess baggage is sold in accordance with general sales conditions, unless otherwise specified.

For a child under the age of 2 who is booked to travel without a seat, the following can be taken along:

• 1 piece of checked baggage with a maximum weight of 10 kg (22 lbs) containing care products for the child.
• A completely collapsible buggy or baby carriage as free checked baggage.
• 1 piece of cabin luggage with articles for care of the child on board with a maximum weight of 10 kg (22 lbs) and maximum dimensions of 55+35+25cm (21+13+10 inch).

It is allowed to take along special baggage such as sporting equipment, music instruments or a pet.

Certain types of sports equipment and musical instrument may form part of the standard free baggage allowance. The maximum weight allowed is 23 kg (50 lbs) and only one piece will be carried free in lieu of the first piece within the free baggage allowance.

Exceptions:

Bicycle, with a maximum weight of 23 kg (50 lbs) and a with the maximum measurement of 158 cm (62 inch), Surfboard, with a length between 107 and 292 cm (42 – 115 inch) and a maximum weight of 23 kg (50 lbs) and Scuba Tank, with a maximum weight of 23 kg (50 lbs) are subject to excess baggage charge.

Other types of special baggage and eventual more than one piece are also subject to excess baggage charges.

Golf bags are an exception: On top of the free baggage allowance a person can take along free of charge one golf bag as checked baggage. A golf bag containing 14 golf clubs, 12 balls and a pair of golf shoes for a total weight of 23 kg (50 lbs).

The carriage of special baggage must always be arranged in advance and timely prior to the day of departure.

MOST SIGNIFICANT CARRIER rule (MSC) with respect to interline carriage.

• If the geographically longest or most significant stretch of your journey is not operated by Surinam Airways, but by another airline, this airline’s rules may also apply to Surinam Airways flights or Surinam Airways flight numbers.
• If Surinam Airways operates the geographically longest or most significant stretch of the journey, then the Surinam Airways rules and charges apply.
• The free baggage allowance is shown on your ticket.
• The MSC rule does not apply to journeys to/from the U.S.A.

SLM is not liable for damage to fragile or perishable articles, money, jewelry, silverware, negotiable papers, securities or other valuables, samples or business documents, which are included in the passenger’s checked baggage, if such damages arise from improper packaging of any of those items by passenger.

NOTICE OF BAGGAGE LIABILITY LIMITATIONS

Liability for loss, delay, or damage to baggage is limited unless a higher value is declared in advance and additional charges are paid. For most international travel (including domestic portions of international journeys), the Montreal Convention will apply, with a liability limit of 1,131 Special Drawing Rights (approximately US$1,775) for checked and unchecked baggage. In some cases, the (amended) Warsaw Convention may apply, with a liability limit of approximately US$ 9.07 per pound (US$ 20.00 per kilo) for checked baggage and US$ 400.00 per passenger for unchecked baggage.

For travel wholly between U.S. points, Federal rules require any limit on an airline’s baggage liability to be at least US$ 3,300.00 per passenger. Some carriers assume no liability for fragile, valuable or perishable articles. Further information may be obtained from the carrier.

ADVICE TO INTERNATIONAL PASSENGERS ON LIMITATION OF LIABILITY

Passengers on a journey involving an ultimate destination or a stop in a country other than the country of origin are advised that the provisions of the (amended) Warsaw Convention, or the Montreal Convention may be applicable to the entire journey, including any portion entirely within the country of origin or destination. These Conventions may limit the liability of carriers for death or bodily injury, and for baggage loss, delay or damage. Many air carriers, including all European Community air carriers, have waived the (amended) Warsaw Convention limits for death or bodily injury and the defence that they have taken all necessary measures to avoid the damage for the first 100,000 Special Drawing Rights of any such claim. Additional protection can usually be obtained by purchasing insurance from a private company. Such insurance is not affected by any limitation of the carrier’s liability under the (amended) Warsaw Convention or the Montreal Convention. For further information please consult your airline or insurance company representative.

CONDITIONS OF CONTRACT

1.    As used in this contract ‘ticket’ means this passenger ticket and baggage check, or this itinerary/receipt if applicable, in the case of an electronic ticket, of which these conditions from part, ‘carriage’ is equivalent to ‘transportation’, ‘carrier’ means all air carriers that carry or undertake to carry the passenger or his baggage hereunder or perform any other service incidental to such air carriage, ‘electronic ticket’ means Itinerary/receipt issued by or on behalf of Carrier, the Electronic Coupons and, if applicable, a boarding document. ‘WARSAW CONVENTION’ means the Convention for the Unification of Certain Rules for International Carriage by Air signed at Warsaw, October 12, 1929, or that Convention as amended at The Hague, September 28, 1955, whichever may be applicable, ‘Montreal Convention’ means the Convention for the Unification of Certain Rules for International Carriage by Air signed at Montreal, 28 May 1999.

2.    Carriage hereunder is subject to the rules and limitations relating to liability established by either the (amended) Warsaw Convention, or the Montreal Convention unless such carriage is not ‘international carriage’ as defined by any of the aforementioned conventions.

3.    To the extent not in conflict with the forgoing, carriage and other services performed by each carrier are subject to: (i) provisions contained in the ticket, (ii) applicable tariffs, (iii) carrier’s conditions of carriage and related regulations which are made part hereof (and are available on application at the offices of carrier), except in transportation between a place in the United States or Canada and any place outside thereof to which tariffs in force in those countries apply.

4.    Carrier’s name may be abbreviated, in the ticket, the full name and its abbreviation being set forth in carriers tariffs, conditions of carriage, regulations or timetables; carrier’s address shall be the airport of departure shown opposite the first abbreviation of carrier’s name in the ticket; the agreed stopping places are those places set forth in this ticket or as shown in carrier’s timetable as scheduled stopping places on the passenger’s route; carriage to be performed hereunder by several successive carriers regarded as a single operation.

5.    An air carrier issuing a ticket for carriage over the lines of another air carrier does so only as its Agent.

6.    Any exclusion or limitation of liability of carrier shall apply to and be for the benefit of agents, subcontractors, servants and representatives of carrier and any person whose aircrafts is used by carrier for carriage and its agents, servants and representatives.

7.    In case of damage to baggage moving in international transportation complaint must be made in writing to carrier forthwith after discovery of damage and, at the latest, within seven days from receipt; in case of delay, complaint must be made within 21 days from date the baggage was delivered. See tariffs or conditions of carriage regarding non-international transportation.

8.    This ticket is valid for carriage for one year from date of issue, except as otherwise provided in this ticket, in carrier’s tariffs, conditions of carriage, or related regulations. The fare for carriage hereunder is subject to change prior to commencement of carriage. Carrier may refuse transportation if the applicable fare has not been paid.

9.    Carrier undertakes to use its best efforts to carry the passenger and baggage with reasonable dispatch. Times shown in timetables or elsewhere are not guaranteed and form no part of this contract. Carrier may without notice substitute alternate carriers or aircraft, and may alter or omit stopping places shown on the ticket in case of necessity. Schedules are subject to change without notice. Carrier assumes no responsibility for making connections.

10.    Passenger shall comply with Government travel requirements, present exit, entry and other required documents and arrive at airport by time fixed by carrier or, if no time is fixed, early enough to complete departure procedures.

11.    No agent, subcontractor, servant or representative of carrier has authority to alter, modify or waive any provision of this contract.

GOVERNMENT FEES

Amounts shown in your receipt under tax/fee/charge concern taxes, fees and/or charges imposed by government authorities and airports and do not form part of the airfare. Where space does not permit the identification of each individual tax, amounts may have been combined. In such cases each individual tax is specified in the fare calculation area. Passengers may be required to pay taxes or fees not already collected. Further information is available upon request at your local SLM office.

NOTICE OF LIABILITY LIMITATIONS

Limits of SLM’s liability

1.    There are no financial limits for death or bodily injury of a passenger and SLM may make an advance payment. In proportion to the suffered loss, in order to meet the immediate economic needs of the person entitled to claim compensation;

2.    In the case of destruction, loss of, damage to or delay in receiving baggage, SLM’s liability is limited to 1,000 Special Drawing Rights (approximately EUR 1,230) for proven damages. If the value of your baggage is greater than this limit, please be advised to declare a value for checked baggage in excess of the applicable liability limits at check-in or ensure that your baggage is fully insured prior to travel;

3.    In the case of damage occasioned by delay in the carriage by air SLM’s liability is limited to 4,150 Special Drawing Rights (approximately EUR 5,100) for proven losses and costs.
